Washington DUI DOL Overview

Thursday, April 19th, 2012

One of the most confusing things for individuals charged with a Spokane DUI is how to deal with the Department Of Licensing.  With deadlines, puzzling letters and potentially thousands of dollars on the line, it is best to have an experienced Spokane DUI Lawyer to lead you through this maze.

DOL Only Gives You 20 Days to Respond

You cannot wait!  You only have 20 days from the date of your arrest to request a hearing.  Depending on whether or not you have a Washington state license, there are a few ways you can request a hearing.  You also want to make sure the DOL has your correct address to avoid any missed letters.  If you get an experienced DUI attorney on board within those first 20 days, they can help you fill out the request letter correctly.

The Confusing DOL Letter You Will Get

You can expect to receive a letter from the Department of Licensing within the first few weeks.  It will advise you that your license will be suspended as a result of the arrest.  It will list the start date and the length of the suspension.  However, if you have requested your hearing within the 20 day deadline, you usually can disregard that letter.  Check with your experienced Spokane DUI Lawyer first.

My Washington Driver’s License Got Punched. Can I Still Drive?

The general rule is that if your license was valid at the time of the arrest for DUI, your license is still valid until one of two things happens.  That’s right, there are two (2) ways you can have your license suspended.  First, by the department of licensing as a result of either not requesting a hearing or after a hearing where the suspension has been sustained.  Second, as a result of a conviction for specific criminal charges, including DUI, Physical Control and Reckless Driving.

Even if the officer has punched your license, as long as you were not suspended at the time of the suspension, you are still able to drive.  Make sure that you keep the bottom portion of the DOL request paperwork in your wallet as proof that you have requested a hearing.

 Washington DOL Hearings

DOL hearings are not like criminal proceedings.  First, the hearing is done over the phone.  Second, there are only certain issues the hearings officer will be basing their decision on.  An experienced Spokane DUI Attorney knows what those issues and is able to spot specific “problems” with the report.

Once you have an experienced Spokane DUI Lawyer on board, they will receive the police report.  An experienced Spokane DUI Lawyer will have you review the report and discuss the option of whether or not you should participate in the hearing.  That’s right, you do not have to participate in the hearing, but your attorney’s strategy may require it and you have an absolute right to participate.

How Do I Find Out The Results Of My DOL Hearing?

The results of a DOL hearing are mailed to you, and you will generally receive them 2-4 weeks after the hearing.  If your license is suspended, you may still be eligible to drive with one of WA State’s provisional licenses, the ignition interlock license.  There are several steps you need to take to actually become a valid ignition interlock licensed driver.  Failure to do any of those steps could result in further criminal charges.

What If My WA Driver’s License is Suspended By DOL?

You may still be able to drive, if you are eligible for an ignition interlock license. However, you will have to pay for the installation and rent of a ignition interlock device. Along with the costs of the ignition interlock device and the provisional license there is the cost of maintaining high risk insurance, SR22 insurance both during the period of your suspension, but also for the following years.  If you do not have a license issued by Washington State, there may be other complications including being barred from driving in the state of Washington during the period of your suspension. Our Spokane DUI Lawyer can help you keep your license and avoid all these costs.

An experienced Spokane DUI Lawyer can help you through this process.  Do not try to do it on your own.  Even if you have a public defender, you can still hire a private attorney to do your DOL hearing.  Spending a few hundred dollars now can save you thousands in the future.

WA Department of Licensing Suspension Revocation Hearings

You Only Have 20 days from the date of your arrest for a DUI to request a license hearing, or you will automatically lose your Washington Drivers License.

Don’t take this lightly! There are all kinds of defenses that our Spokane DUI Lawyers can help you with. You might be surprised at how much money they can save you in the long run. Not to mention a lot of hassles that you just don’t want to deal with.

Here is a quick helpful list of important steps (but not all the steps):

1
Get Legal Help A.S.A.P.
Look you’re under a lot of stress! We get that. However, the sooner you start getting answers and sorting out your options, the better off you’re going to be. DUI is one of the most expensive charges to deal with. Sticking your head in the sand will only make things worse.

Find a Spokane DUI Lawyer that knows what they are doing! Action Legal Group has handled hundreds and hundreds of DUI cases in Spokane WA. Our DUI Lawyers will give you advice, options, and peace of mind. We also have payment plans and fixed flat fees. So no billing surprises.

2
Comparing DUI Lawyers
Not all DUI lawyers are the same. You have to ask questions. The DUI Lawyer that gets overly irritated with your questions or refuses to answer is the one you don’t want.

You should be able to get along with your attorney. You will be working closely with them for the next several weeks to months. Also beware of any lawyer that promises results. Our policy is to never promise, unless we know for sure. In our business, that isn’t very often. Your DUI Lawyer should give you options and set some expectations. Client’s don’t like surprises!

Don’t pick your DUI Attorney on cost alone, if you can avoid it. Try to find some one in your price range that you are comfortable with. It is also a good idea to look at a website like

Look at what other people (testimonials) are saying, and what their peers have said.

3
Request On Time
Make sure that your hearing gets requested on time. Find out for sure whose responsibility it is to send in your DOL Hearing Request. Even if your DUI Lawyer does it for you, put a reminder on your calendar to call and make sure they didn’t forget. The Department of Licensing will not care what the excuse is for being late. They will not make an exception for you.

Ask your DUI Lawyer how you can request your hearing online at the department of licensing website. NOTE: Talk to your lawyer before you take any action on your own. Clear it with them so every one is on the same page and moving toward the same goal.

Spokane Criminal Attorney

You Probably Never Needed A Spokane Criminal Defense Attorney, Before Now. You probably have many questions, but here are the top three questions that our clients usually have.

Why Should I Hire a Spokane Criminal Defense Attorney?

The main reason is your future can be greatly impacted by the next choices that you make in your case. You may make a decision that hurts and that cannot be undone.

Sometimes people try to handle their own cases. This is usually a grave mistake. You may get an offer from the prosecutor that sounds good, but when you actually “look under the hood” it isn’t. You may also be setting yourself up for failure, without realizing it of course. Some deals are just not good.

You have to treat your case like a good carpenter treats his work. Measure twice and cut once. The only difference is a carpenter can buy more wood. You can’t buy a new life. So don’t gamble with your case. Hire a professional Spokane Criminal Defense Attorney.

What Can a Spokane Criminal Defense Attorney Do For Me?

Our Spokane Criminal Defense Attorney can help you understand your case. For example, what is the evidence – the real evidence against, and how it affects you. After hearing your side of the story, our Spokane Attorney (Action Legal Group) can help you find a course of action. (1) Get Your Case Dismissed

(2) Give You Several Options To Settle The Matter

(3) Negotiate a Lesser Charge

(4) Take Your Case To Trial

Can I Afford a Spokane Criminal Defense Attorney?

Yes, most likely you can. You will probably be pleasantly surprised. This is one of the most common fears that clients have. Nobody really saves up to hire a Spokane Criminal Defense Attorney. No one plans on getting arrested.

Dui Lawyer Spokane Now Offers Payment Plans

Wednesday, January 26th, 2011

Nobody ever thinks that they will get arrested for DUI. Washington DUI laws are among the strictest in the United States. Dui is often embarrassing and a shock. Most families do not have a legal fee reserve, and must borrow money from relatives or friends. This, as we all know, can be very embarrassing. Some may not even be able to afford it, or their family may have to financially suffer. Most do not want to choose a public defender over a private DUI attorney. What do you do?

Try and find a DUI attorney in Spokane, Washington that is qualified and offers payment plans. Many attorneys offer payment plans, but you should carefully investigate and question their legal credentials. Most people that are charged with DUI are not looking for the cheapest DUI lawyer in Spokane. They want value for their money. Experience with DUI Law is a huge factor. How long has the Spokane Lawyer been practicing? How many Spokane Dui cases have they handled? What training aside from basic law school training do they have? How many trials have they done? As you can see one must be careful, when choosing a DUI in Washington that claims to offer payment plans. How much could it really cost you?

Generally, the cheapest are the cheapest for a reason. They likely have to cut corners somewhere, but where? Many times you will see that the firm is utilizing legal interns (non-licensed attorneys generally recent graduates or students). This in and of itself is not bad. Lawyers have to start somewhere. However, if you paid the full price, shouldn’t you get what you paid for?

Even worse than paying full price and expecting experience, but not getting it, is Dui Lawyers, or criminal defense attorneys in general, that cut corners and rush the resolution of your case. Your future is too important. A typical Spokane Dui case generally takes from 60 to 90 days. That is of course an estimate based on our years of experience and hundreds of cases.

Action Legal Group is a law firm in Spokane that handles Dui Cases in Spokane, Pullman, Colfax, Ritzville, Davenport, Colville, Moselake. They also have offices in Federal Way and Bellevue Washington.
